JOn January 23, undocumented migrants awaiting regularization could hope for an “exceptional admission to the stay” (AES) thanks to The 2012 Valls circular. The current Minister of the Interior, Bruno Retailleau, replaced him with his own circular. As the Council of State pointed out in its 2013 report on the “Flexible law”these missives to the prefects do not create a new right. These are recommendations of an interpretative and non -imperative nature.

No one is fooled: the recipients of the new circular are not the prefects but public opinion, to whom we want to make believe that MM. Manuel Valls and Gérald Darmanin authorized regularizations “In turn” (sic), “Too quantitative” (re-sic). The prefects had to appreciate these tautologies: remind them that the “Exceptional admissions to the stay must remain exceptional “ and that there is “No automatic right to regularization”it is making them insult.

How did they deal with the files of undocumented migrants? On a case -by -case basis, not over the water. The final decision on the files depended on their discretionary power, with very unequal chances of success from one prefecture to another. In October 2022, An investigation by the Law Commission Confirmed the testimony of associations: about a third of the prefects already renounced applying the Valls circular, for lack of means or will. The offices had to favor the renewal of residence permits. In some prefectures, duly completed regularization files had still not been opened after three years.

Blatant contradiction

What is the balance sheet? In 2023, the number of AES granted thanks to the Valls circular amounted to 34,700: 11,500 for a job, 22,200 for the family and 1,000 to students. These absolute figures impress cheap. However, reported to the 500,000 undocumented migrants who live in France (plausible estimate), it is an annual regularization rate of 7 %. More reliable figure: on all new residence permits granted in France in 2023, only 9.5 % were AES. Supposing that Mr. Retailleau manages to reduce the number of a third, the regularization rate would drop from 7 % to 5 %. How to believe that we would go to the alleged “Migration chaos” to the “Resumption of control” ?
